Terms of Service
AI image and video creation: billing, subscriptions, credits, cancellation, refunds, and acceptable use.

1. Acceptance and Scope
These Terms govern your use of Everygen AI ("we", "us", or "our"), including Image Studio, image generation and editing, Image to Video, Text to Video, and Video Generation. By registering, purchasing, or using the service, you agree to these Terms and our Acceptable Use Policy for AI-Generated Content ("AUP"). Our Privacy Policy explains how personal information is handled. If you do not agree, do not use the service.
You must be at least 18 years old and legally able to enter into this agreement. If you act for an organization, you must be authorized to do so.
2. Service and Account Responsibilities
We deliver digital AI creation tools online, rather than physical goods. Purchased access or credits are provided after payment is confirmed. Features, models, prices, and usage limits are disclosed on the pricing page and at checkout. Some requests are processed by third-party AI providers; availability, processing time, and results depend in part on the selected provider and model.
Provide accurate account and billing information, protect your login credentials, and promptly report unauthorized account activity to support@everygenai.org. You are responsible for your prompts, uploads, and use of generated results. Check outputs before using or publishing them. AI output may contain errors, resemble other content, or fail to meet your artistic preferences; we do not guarantee a particular result.
3. Payments, Subscriptions, and Credits
- Subscriptions: Monthly and annual plans are prepaid. Subscribing authorizes recurring charges at the price and interval shown at checkout until you cancel. Annual plans are charged for the year in advance, with included credits released monthly.
- Credit packs: A separately purchased pack is a one-time transaction and does not itself create an auto-renewing subscription. Credits are service usage units, not money; they cannot be transferred or exchanged for cash except through an eligible refund below.
- Validity: Current subscription credits expire at the end of their applicable monthly allocation period and do not roll over. Current separately purchased packs do not expire; cancelling a subscription does not cancel those packs. Historical purchases retain the validity disclosed when purchased. Applicable expiry dates appear in your credit records.
- Consumption order: Credits with the earliest expiry are consumed first, followed by credits without an expiry. Within the same expiry group, older grants are consumed first. Subscription status alone does not determine the order.
- Price and tax: Checkout discloses the payable amount, currency, billing interval, and applicable taxes. Provide a valid payment method. We give advance notice of changes to recurring prices; changes do not increase the price of an already paid period.
4. Subscription Cancellation
Stop renewal through Account Settings → Billing → Cancel subscription. If you hold multiple subscriptions, cancel each one you want to stop. If you cannot access that flow, email support@everygenai.org from your registered email with your subscription or order number and the subject "Cancel subscription". We respond to email cancellation requests within 2 business days. Use the account flow before the next renewal for immediate confirmation.
After cancellation is confirmed, that subscription will not renew again. Access continues until the already paid period ends, unless it is refunded or restricted for a policy violation. Cancellation does not automatically refund the current period or convert unused credits into cash. Separately purchased credits keep their original validity. Deleting an account does not replace subscription cancellation.
5. Refund Policy
These rules apply separately to subscription payments (including renewals) and one-time credit-pack purchases. "7 days" means 7 calendar days from the relevant payment timestamp. Business days are Monday to Friday, excluding public holidays; processing deadlines are communicated in China Standard Time (UTC+8).
5.1 Eligible Refunds
- Unused subscription within 7 days: You may request a full refund of a monthly or annual payment within 7 days if none of the credits or paid features supplied by that payment have been used. For an annual payment, the window starts at the annual charge, not at each monthly credit release.
- Unused credit pack within 7 days: You may request a full refund within 7 days if no credits from that pack have been consumed. Using unrelated free or promotional credits does not by itself disqualify an unused paid purchase.
- Duplicate or incorrect charge: We refund a verified duplicate charge in full or the verified overcharged amount. Billing-error requests are not limited to the 7-day unused-purchase window.
- Purchase not delivered: If payment is confirmed but purchased access or credits are missing, contact us. We will correct the delivery; if we cannot provide the purchase, we refund the undelivered purchase.
- Verified service failure: If a task fails because of a confirmed technical error and its credits remain deducted, we restore those credits. If a verified continuous outage of at least 72 hours prevents use of a paid subscription, you may choose a cash refund proportionate to the affected paid time or equivalent service credits. If we permanently discontinue a paid service, we refund its unused prepaid period and purchased credits that can no longer be used. The same affected usage cannot receive both a cash refund and replacement credits.
- Mandatory consumer rights: Refund, withdrawal, and other rights required by applicable law remain available. These Terms do not remove them merely because digital delivery has begun or credits have been used.
We assess usage from payment and credit records. Credits returned for a failed task do not count as successfully consumed credits when assessing an unused purchase.
5.2 Non-Refundable Situations
Except for Section 5.1 or where applicable law requires otherwise, we do not refund:
- A subscription payment after its 7-day window or after associated credits or paid features have been used. Cancelling midway through a monthly or annual term does not create a prorated refund entitlement.
- A credit pack after its 7-day window or after any credits in that pack have been consumed. A partially used pack does not qualify for the unused-purchase guarantee.
- Successfully completed generations solely because you dislike their style, composition, or other subjective results, or because a particular result was not guaranteed.
- Free, bonus, promotional, or already refunded credits, or credits that expired under the validity disclosed at purchase.
- Requests based solely on a change of mind, failure to cancel before renewal, or account restriction for an AUP violation, unless the payment independently qualifies under Section 5.1.
5.3 Request Process and Timelines
- Email support@everygenai.org with the subject "Refund request", or sign in and submit a request through Support Tickets. Email requests do not require sign-in.
- Include your account email, order or transaction number, payment date, amount and currency, purchase type, and reason. For a technical failure, include the task ID and screenshots where available. Do not send passwords, full card numbers, or card security codes.
- We verify payment, delivery, and usage records and may request information needed to identify the transaction. An initial request received within the 7-day window preserves its request date while we obtain the necessary details.
- We reply within 2 business days and issue a decision within 5 business days after receiving the information needed to assess the request. We explain the decision and any partial-refund calculation. If a payment-provider investigation takes longer, we notify you of the reason and revised timeline.
- On approval, we submit the refund through the payment provider to the original payment method in the original currency. Funds normally arrive within 5–10 business days after approval, depending on the provider and bank. If the original method cannot receive the refund, we contact you to arrange a provider-supported alternative.
A refund removes the access and credits associated with the refunded amount. A full subscription refund also stops future renewal of that subscription. Contact us if funds have not arrived after the expected posting period. You may reply with additional evidence to request reconsideration of a denial; your statutory dispute rights remain unaffected.
6. Acceptable Use and Six Prohibited Content Categories
These rules cover prompts, uploads, reference files, images, video, edits, and content stored or shared through the service, including private generations. You must not request, generate, upload, store, or distribute:
- Pornography / NSFW: Sexually explicit material, sexual acts, fetish pornography, or nudity intended for sexual arousal.
- Violence / gore: Graphic injury, torture, mutilation, dismemberment, or content promoting, glorifying, or inciting violence.
- Hate speech: Content attacking, dehumanizing, or advocating discrimination or violence against people based on protected characteristics such as race, ethnicity, religion, sex, sexual orientation, gender identity, or disability.
- Child-unsafe content / CSAM: Child sexual abuse material, sexualization or exploitation of anyone under 18, grooming, or content facilitating child abuse. Synthetic, fictional, and age-ambiguous depictions are included.
- Deepfakes / impersonation of real people: Deepfake content or impersonation of identifiable real people, including fabricated endorsements, identity fraud, deceptive depictions of events, or non-consensual intimate imagery.
- Copyright / trademark infringement: Use of protected works, characters, logos, brands, or other intellectual property without permission or another valid legal basis, including counterfeit branding or misleading affiliation.
Illegal activity, threats, harassment, privacy violations, fraud, malicious software, and unauthorized system access are also prohibited. Do not bypass safety filters, disguise prohibited requests, create replacement accounts to evade enforcement, or present AI output as authentic evidence of a real event. The AUP provides detailed standards, review, reporting, enforcement, and appeals.
7. Review, Reporting, and Enforcement
Our review mechanism combines platform automated checks, provider safety filters, and human review, as described in the AUP. Automated checks can refuse a request or require further review. Passing a check does not authorize a policy violation. Detection can make mistakes and cannot identify every violation.
Anyone can report suspected violations, child-safety concerns, impersonation, or infringement by emailing support@everygenai.org with the subject "Content safety report". Signed-in users can also use Support Tickets. Provide the content URL or task ID, reason, and supporting information. Do not attach or redistribute suspected CSAM. We acknowledge reports within 2 business days and aim to provide an initial decision within 7 business days after obtaining sufficient information, prioritizing child safety and imminent harm.
Depending on severity and repetition, we may reject generation, warn users, remove content or revoke sharing under our control, restrict features, suspend access during investigation, or terminate access for serious or repeated violations. Where legally required or permitted, suspected illegal activity may be referred to competent authorities. Serious violations may result in immediate action without warning. We normally explain the action unless doing so would compromise safety, an investigation, or a legal obligation. Enforcement does not remove applicable refund rights under Section 5. Users may appeal within 14 calendar days under the AUP.
8. Intellectual Property and Privacy
Platform software, the interface, and our own branding remain our intellectual property. You retain your rights in submitted content and authorize us and our providers to process it as necessary to deliver the requested service, investigate abuse, and comply with law, consistent with our Privacy Policy.
Use of generated output is subject to applicable law, these Terms, and disclosed model-specific licensing restrictions. We do not guarantee that output is unique, copyrightable, or free of third-party rights. Obtain required permissions for source material and recognizable people, and review output before commercial use or publication.
9. Service Changes and Account Closure
We may modify or suspend features for operational, safety, or legal reasons, giving reasonable notice where practicable. Contact support to request account closure, and cancel active subscriptions first. Closure alone does not create refund eligibility; Section 5 continues to apply. If we end a paid service or your access for reasons unrelated to your breach, we refund unused prepaid service and unusable purchased credits.
10. Liability and Consumer Protections
The service is provided on an "as available" basis. To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss arising from use of the service. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded, or limits an express refund obligation in Section 5.
11. Updates and Contact
The date above identifies this version. We notify users of material changes through the service or email where appropriate. Changes do not retroactively reduce refund rights attached to an existing purchase.
